1. On the immovable property whose province, district, neighborhood, block number, parcel number, area, share, zoning status, appraised price, temporary guarantee, tender date and tender time are written above and which belongs to Tarsus Municipality, a project has been prepared by Tarsus Municipality in accordance with the 1/1000 scale zoning plan for the construction of 1+1 residences, a floor easement consisting of 103 Independent Sections has been established in the title deed, construction permits have been obtained, and the tender for the construction of independent sections that will fall on the immovable property owner Tarsus Municipality in return for a land share, at least 33% (thirty-three percent) of the total construction area of 7090 m², will be made by the Closed Bidding Procedure in accordance with Article 35/a of the State Tender Law No. 2886.
2. The estimated cost of this work has been determined based on the 2025 Approximate Construction Unit Cost of the IIIrd Class B Group building specified in the Communiqué on the 2025 Approximate Construction Unit Costs to be Used in the Calculation of Architectural and Engineering Service Fees of the Ministry of Environment, Urbanization and Climate Change and the current land price of the real estate.
3. The tender will be held in the Municipal Council Hall, located in the administrative building of the Municipal Facilities on Kasım Gülek Boulevard, Tozkoparan Zahit Neighborhood, on the date and time specified above, in the presence of the Municipal Council. Natural or legal persons participating in the tender must submit the documents specified in the announcement to the administration.
4. The provisional guarantee fee for the tender is 3% (three percent) of the reserve price, and the bidders who will participate in the tender must submit their provisional guarantees as follows;
a. Those who will deposit the payment in cash must deposit the amount into the Tarsus Municipality Ziraat Bankası Official Branch account number TR89 0001 0017 8234 1199 0251 0 5 I BAN or at the Tarsus Municipality Revenue Directorate cashier's office, and then place the bank receipt or payment receipt in the outer envelope. The bank receipt or payment receipt must include the neighborhood name of the tender in question, the block and parcel number, the bidder's Turkish ID/Tax Number, and a temporary guarantee in the description section.
b. If a letter of guarantee is to be provided, the applicant must include in the outer envelope a bank guarantee letter issued by banks and private financial institutions, issued in accordance with Articles 26 and 27 of State Tender Law No. 2886, approved by two authorized persons, and confirmed by the branch or headquarters, with an unlimited term and within the limit. The letter of guarantee must include the neighborhood name, block and parcel number of the tender to be participated in, the applicant's Turkish ID/Tax Number, and a temporary guarantee.
5. To participate in the tender, applicants must meet the qualifications specified in State Tender Law No. 2886, submit an offer as described in the said law, and deposit a provisional guarantee. Documents required for tender participation are as follows:
a. Tender participation petition,
b. Providing a legal residence document or an address in Turkey for notification,
c. Copy of ID Card or photocopy of ID card with Turkish ID number,
d. The original copy of the bank guarantee letter along with the receipt, bank receipt or bank confirmation letter showing that the temporary guarantee has been deposited,
e. Original receipt or bank receipt showing that the specification fee has been paid,
f. Written declaration that they are not prohibited (penalized) according to the State Tender Law No. 2886,
g. They are required to submit a letter stating that they have no outstanding debts, including rent, fines, real estate, environmental tax, or other debts, from the Tarsus Municipality Revenue Directorate.
5.1- For natural persons , except for the documents required in Article 5 ;
a) A document obtained from the chamber of commerce and/or industry or chamber of tradesmen and craftsmen or relevant professional chamber where the bidder is registered, within the year in which the tender was held, showing that the bidder is registered to the chamber,
b ) The bidder's signature declaration obtained from the notary,
c ) If the tender is being participated in by proxy on behalf of the bidder, the power of attorney and signature declaration of the person who will make the bid on behalf of the bidder, obtained from a notary public,
5.2 - For legal entities, except for the documents required in Article 5 ;
a) Private law legal entities; the original of the Turkish Trade Registry Gazette or a certified copy obtained from the Notary/Trade Registry Office, a registry record obtained from the court where the administrative center is located or from the Chamber of Commerce and Industry where it is registered or from a similar authority within the year in which the tender was held (it must be approved by the Turkish Consulate in the country where the foreign legal entity without a branch in Turkey is located or by the Turkish Ministry of Foreign Affairs), and a signature circular or power of attorney approved by a notary public showing that the persons who will participate in the tender or make an offer on behalf of the legal entity are authorized to represent the legal entity.
b) For public legal entities, a document stating that the persons who will participate in the tender or make an offer on behalf of the legal entity are authorized to represent the legal entity,
5. 3 - If it is a Cooperative, Union , Association or Foundation, except for the documents required in Article 5 ;
a) Document showing the authority to make a construction contract in return for a land share, obtained from the authorized bodies,
b) Signature declaration of the authorized person or persons obtained from a notary public,
5. 4 - In case of a joint venture, except for the documents required in Article 5 ;
a) Notarized joint venture declaration or business partnership agreement,
b) The documents required in Article 5 must be submitted separately by each partner.
c ) A notarized power of attorney, if the real persons constituting the joint venture are also represented by proxy.
5.5- Since the subject of the tender in the announcement is the construction of a building in return for a land share , the bidders are requested to submit the following documents in addition to the documents specified in Article 5 :
a) The total of the works carried out under contract within the last 15 years, at least 50% (fifty percent) of the estimated cost of the work, a work completion certificate suitable for the structures defined in the III. Class B Group and above groups specified in the Communiqué on Construction Approximate Costs of the Ministry of Environment, Urbanization and Climate Change or a work completion certificate for the II. Group works of the Public Procurement Agency's Communiqué on Similar Work Groups in Construction Works, (B) Superstructure (Building) Works,
b) Contractor certificate showing that the Ministry of Environment, Urbanization and Climate Change has the qualification to construct residential buildings of 7090 m² and above in the Class III Group B building class specified in the Communiqué on Construction Estimated Costs.
c ) If the bidder is a company, a document stating the company partners and their shares and duties, together with the approved company articles of association.
d ) Document showing that there is no SSI debt/tax debt or that restructuring has been done (must be received at most 15 days before the tender date.)
e ) Declarations and documents regarding the activity period,
f ) A bank reference letter confirmed by the head office, unused in cash or non-cash, not less than 10% (ten percent) of the appraised amount,
g ) Site Visit Certificate,
h ) In case the work is to be done by subcontractors or not, a letter of undertaking stating that the bidder will or will not have subcontractors,
6. Bidders are deemed to have accepted the technical and administrative specifications and their annexes related to the tender. The cost of the specifications is 10,000.00 TL . The specifications must be deposited into the Tarsus Municipality's account number TR89 0001 0017 8234 1199 0251 05 I BAN at the Ziraat Bank Official Branch or at the Tarsus Municipality Revenue Directorate. The specifications must be obtained from the Tarsus Municipality Real Estate and Expropriation Directorate; Rent, Sales, and Allocation Department. The bank receipt or payment receipt must include the neighborhood name, block and parcel number of the tender in question, the bidder's Turkish ID/Tax Number, and the specification fee in the description section.
7. Specifications can be examined free of charge at the Real Estate and Expropriation Directorate; Rent, Sales and Allocation Directorate.
8. Information regarding the tender can be viewed on the Tarsus Municipality website.
9. For the tender to be held on Wednesday , September 17 , 2025 , bidders must submit their bid letters, prepared in accordance with Article 37 of the State Bidding Law No. 2886, along with all the required documents, provided that they have reached the Tarsus Municipality Real Estate and Expropriation Directorate, Rental, Sales, and Allocation Department, by 5:00 PM on Tuesday, September 16 , 2025 , or send them by registered mail with return receipt requested. Neither the Administration nor the Tender Commission assumes any responsibility for delays that may occur in the mail. Individuals and legal entities participating in the tender in person must be present at the Municipal Council Hall on the day and time of the tender.
10. The Tender Commission is free to decide whether to conduct the tender and to determine the appropriate price/rate, stating the reasons in its decision. The Commission's decision not to conduct the tender cannot be appealed. If the decision is made not to conduct the tender, the preliminary guarantees received from the bidders will be refunded.
11. Persons specified in Article 6 of the State Tender Law No. 2886 cannot participate in this tender.
