Starting September 17, employers will be required to pay the proportional share of the Infonavit credits of their employees who are disabled or absent, according to the Social Security Law. Previously, these deductions were temporarily suspended during the disability period.

The change was published on February 21 in the Official Gazette of the Federation , through a decree that reforms the Infonavit Law and the Labor Law, specifically modifying Article 29 of the Infonavit.

With this reform, employers are jointly responsible for the payment of housing loans while the employee is absent due to illness, accident, or pregnancy.

Failure to comply with this obligation may result in:

  • Requirement for payment of the debt through a tax credit.
  • Possible fines and surcharges.

According to Alberto Díaz de León, a labor law specialist, the measure represents a significant administrative impact , especially in companies with large payrolls. For example, in a company with 5,000 employees, even a small percentage of disabled workers can generate a considerable financial burden.
